  1. The types of personal information we collect about you 

Depending on how you use the Website and interact with us, we may collect several types of information from you, including:

  • Personal Identifiers: name,  shipping/billing address, email address, telephone number, month and date of birth.
  • Physical Characteristics: shoe and clothing size, gender. 
  • Account Information: username and password if you create an account on the Website, loyalty account number.
  • Payment Details: credit or debit card information and billing address when you make a purchase. 
  • Purchase History: records of products you’ve purchased or considered, including an order number to allow you to find information about orders and returns.
  • Device and Usage Information: IP address, browser type, browser version, operating system, referring URLs, and information about your interactions with the Website, such as pages viewed and links clicked, products you add to your cart and products you choose to review. 
  • Location Data: general location information based on your IP address in order to, for example, identify Skechers stores near you.
  • Cookies and Similar Technologies: data collected through cookies, pixels, tags, web beacons, and similar technologies to personalise your experience and analyse Website traffic, including marketing that led you to our Website, and Website usage details as further described in our Cookies Policy

We use different methods to collect this information from and about you including through:

You may give us your personal information when making an online or in-store retail purchase, or when registering for a Skechers Website account, for Skechers marketing emails, for a Skechers sweepstakes or giveaway, or for Skechers Plus™ program (or other loyalty program), either in person, at an event, or online.

  3. If you give us feedback or contact our customer service department, you may need to provide us with additional information so we can respond to your questions and concerns as completely and thoroughly as possible.
  4. In order to provide an enhanced customer experience, we may occasionally request additional information such as your gender, shopping preferences, product interest, and email notification preferences. Whether you provide this information is completely optional and up to you.
  • Automatically As You Navigate Our Website. We use automatic data collection technologies, including third-party services, to collect Device and Usage Information and additional information about your equipment, browsing actions, and patterns through Cookies and Similar Technologies. 

Why We Automatically Collect This Information. Automatically collecting this information helps us to maintain and improve our Website. It also allows us to verify system and server integrity and to provide you with more personalised service. For example, using cookies or through your logging in as a Skechers Plus™ member, we can recognise you when you return to our Website and provide you with a customised Website experience based on your stored preferences and individual interests. 

How We Automatically Collect This Information. We automatically collect this information using cookies and web beacons. 

A cookie is a small removable text file that is downloaded onto your computer, mobile phone, tablet or other device when you access a website. Skechers uses three types of cookies: (1) cookies required to enable core site functionality such as log-in, the shopping cart, checking out, product searching, store locator services, and estimated shipping costs; (2) cookies that enable additional site functionality such as recognition of Skechers Plus™ membership and promotion codes; and (3) advertising cookies that are used by Skechers and/or third party companies to track your Website use and links you have followed in order to deliver content tailored to your interests both on our Website and elsewhere. A web beacon is a small electronic file contained on pages of our Website that permits Skechers to count users who have visited those webpages or opened an email.

  • Third-Party Use of Cookies and Other Tracking Technology. Some content or applications, on the Website are served by third parties, including providers of external services like web traffic analysis services. These third parties may use cookies alone or in conjunction with Cookies and Similar Technologies to collect information about you when you use our Website. The information they collect may be associated with your personal information or they may collect information, including personal information about your online activities over time and across different websites and other online services. They may also use this information to provide you with behavioral advertising or other targeted content. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. We also work with other companies who use cookies to serve ads on our behalf across the Internet.   1. Legal Bases for Processing Personal Information

The law requires us to have a legal basis for collecting and using your personal information. We rely on one or more of the following bases when collecting and using your personal information: 

  • When Necessary For Us To Enter Into And To Perform A Contract With You. For example, in order to fulfill an order you placed on our Website or in-store, we may need to use your Personal Identifiers, Payment Details and  Physical Characteristics. 
  • When You Provide Us With Consent To Process Your Personal Information. For example, when opting into receiving email marketing, you are consenting to us processing your Personal Identifiers and Communication Preferences to send you emails on special offers and sales, product launches, and Skechers events. You may withdraw this consent at any time in the manner described below in the Skechers’ Email and Text Communications section.
  • When Complying With A Legal Obligation. For example, certain laws and/or regulations may require Skechers to collect and retain information for a certain amount of time for tax purposes, or to prevent fraud and other illegal activities.
  • We May Also Process Your Personal Information For Our Legitimate Interests. We may use your personal information where it is necessary to conduct our business and pursue our legitimate interests, for example to prevent fraud and enable us to give you the best and most secure customer experience. We make sure we consider and balance any potential impact on you and your rights (both positive and negative) before we process your personal information for our legitimate interests. We do not use your personal information for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

The telephone and credit card number information we ask for when you order online is used only to complete the order, confirm the order and confirm shipment of the order. Limited credit card information is then stored only for the purposes of faster checkout (for Skechers Plus Members only), and is not used for any other purpose.

  1. Sharing Information with Third Parties

Except as described in this Privacy Notice, Skechers does not sell, rent or trade any personal information you provide to us online or at our stores, nor do we share such information with third parties. We may disclose personal information that we collect or you provide as described in this Privacy Notice:

  • To our subsidiaries and affiliates, which may require transferring your information outside of the United Kingdom.
  • To our agents, contractors, business partners, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them. Examples of these services include payment processing and authorisation, fraud protection and credit risk reduction, product customisation, order fulfillment and shipping, advertising strategies, marketing and promotional material distribution, Website usage evaluation, data analysis and, where applicable, data cleansing. We also may share non-personal information (such as the number of users who visited the Website during a specific time period or who purchased a specific product through the Website) with our marketing partners, advertisers and others from time to time. This information generally is shared in an aggregated form. 
  • To third parties, such as credit agencies, to verify delivery names and addresses for online orders. If you provide us with a delivery name and address which is not your own, you must have that person’s permission to give us their personal information and for us to use it for the purposes specified. By providing it, you are affirming that you have their permission to do so.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganisation, dissolution, or other sale or transfer of some or all of Skechers assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Skechers about our Website users or in-store customers is among the assets transferred. If that happens, your personal information may be disclosed to another company, but that disclosure will be subject to Skechers’ Privacy Notice.
  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • If we believe disclosure is necessary to protect the rights, property, or safety of Skechers or any of our respective affiliates, business partners, customers, or others.
  • To fulfill the purpose for which you provide it. 
  • For any other purpose disclosed by us when you provide the information.

  1. International Transfers of Personal Information

In certain circumstances, Skechers may deem it necessary to store, share, or process your personal information outside of the country in which your personal information was originally collected, including the United States and/or countries outside the United Kingdom that have not been recognised by the UK Government as providing an adequate level of data protection. Such transfers of personal information will be protected by appropriate safeguards, such as the International Data Transfer Agreement or the International Data Transfer Addendum to the European Commission’s Standard Contractual Clauses for international data transfers.

  1. Children's Privacy

Skechers takes special care to protect the safety and privacy of children. Our Website is not intended for individuals under 16 years of age. We do not permit anyone under the age of 16 to register with us, nor do we knowingly send email correspondence or knowingly collect personal information from individuals under 16. If you are under 16 years of age, do not use or provide any information on this Website. If we learn we have collected or received personal information from an individual under 16 without verifiable parental consent, we will delete that information.

  1. Skechers’ Email and Text Communications

During the purchase process on our Website when your personal information is collected, you will be asked to indicate your preferences for receiving direct marketing communications from Skechers via email or text. The marketing communications contain special offers that might become available, and other information Skechers believes will be of interest to Website visitors. Skechers may also analyse your Personal Identifiers, Purchase History and Device and Usage Information to form a view which products may be of interest to you so that we can then send you relevant marketing communications.  Skechers will send these types of communications to you only if you opt-in to receive Skechers marketing communications (by registering to receive our email or text updates, during the purchase process, registering for the Skechers Plus™ program, signing up in person at a Skechers event, or by contacting our customer service department and specifically requesting to be added to our marketing list(s)). 

Opt-out / Unsubscribe

You may request that you stop receiving electronic communications from Skechers anytime. You can cancel emails by updating your contact preferences on our Website or following the instructions contained in the footer of our marketing emails. To unsubscribe from SMS, MMS or other mobile messaging, you may also follow the instructions in the messages you receive. We will process requests as promptly as possible but it takes some time to put opt-outs in effect, so you may still receive electronic communications from Skechers for several weeks after your request is received.

Please note this opt-out does not apply to emails sent by Skechers related to your orders such as order and shipment confirmations, service-related communications that are essential for administrative or customer service purposes (for example relating to order confirmations, updates to our Terms and Conditions, checking that your contact details are correct, and Skechers’ email responses to enquiries you make online). 

  1. Data Retention

We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorised use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

By law we have to keep basic information about our customers (including Personal Identifiers and Payment Details) for six years after they cease being customers for tax purposes.

In some circumstances you can ask us to delete your personal information: see paragraph 11 below for further information.

In some circumstances we will anonymise your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

 

  1. Your Legal Rights

Under UK data protection laws, you have a number of rights in relation to your personal information. You may: 

  • Withdraw consent to processing at any time where the basis for processing is consent. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent;
  • Request access to your personal information (commonly known as a "subject access request"). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it;
  • Request erasure of your personal information in certain circumstances. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal information to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Request that Skechers rectify inaccurate data or to complete incomplete data, though we may need to verify the accuracy of the new personal information you provide to us;
  • Request restriction of processing of your personal information. This enables you to ask us to suspend the processing of your personal information in one of the following scenarios:
    • Ii you want us to establish the accuracy of the personal information;
    • where our use of your personal information is unlawful but you do not want us to erase it;
    • where you need us to hold your personal information data even if we no longer require it as you need it to establish, exercise or defend legal claims; or
    • you have objected to our use of your personal information but we need to verify whether we have overriding legitimate grounds to use it;
  • Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) as the legal basis for that particular use of your personal information (including carrying out profiling based on our legitimate interests). In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your right to object; and 
  • Request the transfer of your personal information to you or to a third party. We will provide to you, or a third party you have chosen, your personal information in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

These rights are not absolute and may be subject to one or more exceptions.

We reserve the right to deny data subject requests if we believe the request is subject to one or more exceptions or if the request would violate any legal requirement or cause the information to be incorrect.

In order to protect your privacy, Skechers takes steps to verify your identity before granting data subject access requests. Skechers will accomplish this through the use of passwords and personal information. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. 

You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK regulator for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within 1 month of its receipt. If we require more time (up to 3 months in total), we will inform you as soon as possible and within the first month of receiving your request, of the reason and extension period in writing.

If you have an account with us that is linked to an email address, we will deliver our written response to that email address. If you do not have an email address registered with us, we will deliver our written response by mail or electronically, at your option. If applicable, the response we provide will also explain the reasons we cannot comply with a request. 

For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.

  1. Data Security

Skechers has in place technologies and processes that are intended to reduce the likelihood of unauthorized access to information and to help improve data security. However, no method of transmitting information over the Internet or method of electronic storage is completely secure and we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk.

We will post any updates we make to our Privacy Notice on this webpage. If we make material changes to how we treat our customers’ personal information, we will notify you by email to the email address specified in your account and/or through a notice on the Website home page. The date the Privacy Notice was last updated is identified at the top of the page.
